Limitation of Liability.

Copyrights and Copyright Agents.

Legal Compliance.
You agree to comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of the Site and the Content and Materials provided therein.
Miscellaneous.
This Agreement shall be treated as though it were executed and performed in San Diego, CA, and shall be governed by and construed in accordance with the laws of the State of California (without regard to conflict of law principles). Any cause of action by you with respect to the Site must be instituted within one (1) year after the cause of action arose or be forever waived and barred. All actions shall be subject to the limitations set forth herinafter. The language in this Agreement shall be interpreted as to its fair meaning and not strictly for or against any party. Any rule of construction to the effect that ambiguities are to be resolved against the drafting party shall not apply in interpreting this Agreement. The headings in this Agreement are included for convenience only and shall neither affect the construction or interpretation of any provision of this Agreement nor affect any of the rights or obligations of the parties to this Agreement. Should any part of this Agreement be held invalid or unenforceable, that portion shall be construed as much as possibly consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that anything in or associated with the Site is in conflict or inconsistent with this Agreement, this Agreement shall take precedence. Our failure to enforce any provision of this Agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision. Our rights under this Agreement shall survive any termination of this Agreement.
The individuals depicted at the top of the website on the home page are models. They are not meant to represent any Allen Barron client or potential client or any Allen Barron attorney or staff member.
Arbitration.
Any legal controversy or legal claim arising out of or relating to this Agreement or the Site (excluding legal action taken by us or you to collect or recover damages for, or obtain any injunction relating to, intellectual property ownership or infringement), shall be settled solely by confidential binding arbitration in accordance with commercial arbitration rules. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in San Diego, California. Each party shall bear one-half of the arbitration fees and costs incurred, and each party shall bear its own attorneys’ fees.
ACCESIBILITY
Allen Barron, Inc. is dedicated to providing an excellent user experience for everyone, including those with vision, hearing, cognitive or motor impairments, and is committed to ensuring digital accessibility and the continual improvement of the allenbarron.com user experience.
Conformance Status.
The Web Content Accessibility Guidelines (WCAG) defines requirements for designers and developers to improve accessibility for people with disabilities. It defines three levels of conformance: Level A, Level AA and Level AAA. Allen Barron, Inc.’s target conformance level is WCAG 2.0 Level AA. While allenbarron.com’s conformance with the target level has not yet been formally assessed, it has been identified that the site is non-conformant with WCAG 2.0 AA, meaning that the content does not currently conform to the accessibility standard.
Approach to Conformance.
Allen Barron, Inc. is actively pursuing full WCAG 2.0 AA conformance. As part of this pursuit, we have outlined the following initial steps on the path to conformance:
- Identify a third-party vendor with accessibility expertise to conduct an accessibility audit of allenbarron.com for conformance with WCAG 2.0 AA guidelines. We anticipate the audit will be completed by the end of Q3, 2021, but this is subject to the vendor selection process and the selected vendor’s availability to complete the audit.
- In partnership with the accessibility vendor, we also aim to create a company-wide accessibility policy that establishes accessibility as a core feature of our digital products and currently expect the policy to be published following the completion of the audit and remediation prioritization exercise. We anticipate the policy should include the following contents:
- Accessibility Standards & Target Conformance Level
- Scope of Policy
- Conformance Milestones with Target Dates for Conformance
- Accessibility Monitoring and Review Process
- Strategic Planning for sustaining and extending Accessibility across the organization, including plans for training and procuring services from third-parties that meet the accessibility standards in the policy.
- As part of the accessibility audit, we expect the vendor to provide the full list of identified conformance issues and will collaborate with the vendor to prioritize remediation efforts in accordance with the appropriate conformance milestones as defined in the accessibility policy. We anticipate the milestones will be prioritized to address successful remediation of Level A and / or high-impact issues before addressing successful remediation of Level AA issues.
- Changes to allenbarron.com’s conformance status and any progress made towards conformance will be documented and communicated through regular updates to the accessibility policy and this accessibility statement on a quarterly basis.
