ABCast Episode 2 focuses on “the Process of an IRS Audit.”  San Diego tax attorney Janathan Allen discusses what a US taxpayer needs to understand about an IRS audit, their rights as a taxpayer and how to handle themselves.  This podcast discusses what to do from the moment you receive a letter of notification of an IRS audit to the point in which the process is completed.

This includes one of the most important and often surprising facts for most US taxpayers – you don’t have to talk to the IRS.  When we represent clients in an IRS audit we handle all communications with the IRS.  This takes a lot of pressure and stress off of our clients and allows us to protect their interests and keep the IRS focused.  The IRS usually starts by requesting additional information.  The mistake many taxpayers make is to talk too much and to provide too much information in an effort to look open and cooperative.  Unfortunately the IRS Revenue Officer will simply use all information provided to expand the scope of the audit ultimately costing the taxpayer more money.

Another surprising fact Janathan discusses in ABCast Episode 2 “the Process of an IRS Audit. is the obligation of a CPA, accountant, tax preparer or financial advisor to provide any and all information requested by the IRS, included their own written notes and work papers.  Jan discusses the protections of the attorney-client privilege and how working with her in her role as a tax attorney allows Allen Barron’s clients to have an open (read: confidential and protected) conversation so that she can understand the facts and work to protect our client’s interests.  The IRS cannot compel information which is shared in confidence with an attorney.
